The bill (Reg. No.6078) offers legislative regulation of activity of civil aviation in Ukraine, harmonizing it with the international air law. The bill was drafted to meet the requirements of the International Civil Aviation Organization (ICAO), the European Union, the European Civil Aviation Conference (ECAC), and the European Organisation for the Safety of Air Navigation (EUROCONTROL), as well as the amendments in the Ukrainian legislation made after the enactment of the Air Code of Ukraine in 1993.
The Committee members stated that on the whole, the draft complied with the legislation of the European Union.
However, several provisions of the bill partially considered the international legal regulations. Thus, the draft code fails to include the provisions of the Regulation (EC) No 261/2004 of the European Parliament and of the Council of 11 February 2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights.
Clause 123 of the draft code fails to take into account the provisions of Regulation (EC) 785/2004 of the European Parliament and of the Council of 21 April 2004 on insurance requirements for air carriers and aircraft operators.
The Committee members believe that the draft code should take into account the provisions of Council Regulation (EC) No 1107/2006 of 5 July 2006 concerning the rights of disabled persons and persons with reduced mobility when travelling by air and Commission Regulation (EC) No 482/2008 of 30 May 2008 establishing a software safety assurance system to be implemented by air navigation service providers.
